The Food and Drug Administration shut the plant in late September after its products were linked to 41 cases in 20 states.

District Judge Sarah Singleton concluded a hearing Monday by saying nothing in the New Mexico Constitution bars the state from paying for private schools' instructional materials.

48 dogs were seized from Debra Clopton’s Edgewood property on April 1. Three of the dogs were later put down. Clopton now faces animal abuse charges.

Monday, a judge ordered Clopton to pay $20 per dog, per day [if she wants to get them back] unless she agrees to surrender them so they can be adopted out.

Clopton has 15 days to pay; charges will keep mounting until then [if she wants to get them back]. If she doesn't pay, the dogs will be turned over to Santa Fe county.
