“This is not a free market,” Evans said. The federal health care law requires people to have health insurance — they don’t have a choice, she said. “I think it is ridiculous when they talk about a free market like people are going to McDonald’s.”

Navigators’ pay, at least in the first year of the exchange’s operation, is also a concern. Currently, federal funds can pay to train navigators but can’t be used to fund their salaries. The exchanges are expected to generate revenue to pay the navigators, but until the exchange gets started, those funds aren’t available, state officials say.

Organizations such as New Mexico Voices for Children want state policymakers to appropriate $2 million in the proposed state budget to pay navigators’ salaries. But so far, the Martinez administration has resisted that idea.

2:1 male/female (cats)

... i think there are three male kittens, and one female kitten ... plus papa cat and mama cat ...

... yesterday i saw fur face, camo, and the dark one playing with papa cat ... he was rubbing up against a tree and a bald plant of some sort ... letting mama cat know he's still around in case she's chilled out ...

the kittens were trying out their attack and slap skills against him ... they weren't very good ... they would sneak up to him, jump in the air (like in the matrix) and swing and kick ... but nothing would connect ... and, of course, once papa cat turned and looked at them they freaked out and ran away ... hahhah ...

he entertained them ... it was all in good humor ... but i noticed then, that milky wasn't with the others ... and found her hanging out in the freezer room with mama cat ... so that was the first hint ... and then this morning i saw her putting her butt up in fur face's face ... so that isn't good ...

[rancher's wife] says not to worry about them and population control ... she says nature works fast out here and that the cats go just as fast as they come ...

it'll be sad when that starts happening ... but there are hawks, and eagles, and coyotes, and owls ... and spring just around the corner.

The Albuquerque Journal reported that the school will be called New Mexico Connections Academy and will contract with the online, for-profit curriculum company Connections Academy. The school aims to serve students in grades K-12 from around the state.

rooting for the groundhog (early spring)

it is snowing ... maybe 2 inches outside ... been snowing for about 3 hours now ... [weather website] says: snow today, getting better monday ... tuesday sunny, and all week 40s/10s ... then beginning saturday, following week is 50s/20s ...

i heard that if [the groundhog] did NOT forecast an early spring, that spring would come in the middle of march ... but the groundhog DID forecast an early spring ... so that must mean before the middle of march ...

the forecast was made by [the groundhog] on feb 2 ... and the middle of march is 6 weeks from there ... so early spring means 3-6 weeks from feb 2, to me ... so that means, our target zone for an early spring starts TODAY ... and lasts for three weeks ... based on [the groundhog] ...

the reason this is important is because i am just about out of firewood ... i count 10 pieces ... and i do not want to purchase or cut more wood ... i will use it very sparingly ... and maybe i can scrounge a few pieces from [a friend] ...

so we are rooting for [the groundhog] to be right ... and according to the extended forecast on [weather website], the mid-50's are only one week out ...

come on early spring! ... i think i can make it ... (famous last words).

Rep. Mary Helen Garcia, D-Las Cruces, wants to take the Public Education Commission out of the Public Education Department to create a separate, independent entity. Her House Bill 392 would eliminate the authority of the department’s secretary [Hana Skandera Secretary-designate] to review charter school appeals.

“The Public Education Commission should be a stand-alone entity,” Garcia said in a news release. “To grant or review a charter request and render a decision on substantial evidence can be time consuming, and to determine whether the decision is arbitrary or capricious is a great responsibility — these are duties that should fall under the Public Education Commission solely. Decisions like these should not be influenced by politics.”

B.   A charter applicant or governing body that wishes to appeal a decision of the chartering authority concerning the denial, nonrenewal, suspension or revocation of a charter school or the imposition of conditions that are unacceptable to the charter school or charter school applicant shall provide the secretary with a notice of appeal within thirty days after the chartering authority's decision.  The charter school applicant or governing body bringing the appeal shall limit the grounds of the appeal to the grounds for denial, nonrenewal, suspension or revocation or the imposition of conditions that were specified by the chartering authority.  The notice shall include a brief statement of the reasons the charter school applicant or governing body contends the chartering authority's decision was in error.  Except as provided in Subsection E of this section, the appeal and review process shall be as follows within sixty days after receipt of the notice of appeal , the secretary, at a public hearing that may be held in the school district in which the charter school is located or in which the proposed charter school has applied for a charter , shall review the decision of the chartering authority and make findings.  If the secretary finds that the chartering authority acted arbitrarily or capriciously, rendered a decision not supported by substantial evidence or did not act in accordance with law, the secretary may reverse the decision of the chartering authority and order the approval of the charter with or without conditions.  The decision of the secretary shall be final.
C.   The secretary, on the secretary's own motion, may review a chartering authority's decision to grant a charter .  Within sixty days after the making of a motion to review by the secretary, the secretary, at a public hearing that may be held in the school district in which the proposed charter school that has applied for a charter will be located, shall review the decision of the chartering authority and determine whether the decision was arbitrary or capricious or whether the establishment or operation of the proposed charter school would:
(1)   violate any federal or state laws concerning civil rights;
(2)   violate any court order; or
(3)   threaten the health and safety of students within the school district.
D.   If the secretary determines that the charter would violate the provisions set forth in Subsection C of this section, the secretary shall deny the charter application.  The secretary may extend the time lines established in this section for good cause.  The decision of the secretary shall be final.
E.   If a chartering authority denies an application or refuses to renew a charter because the public school capital outlay council has determined that the facilities do not meet the standards required by Section 22-8B-4.2 NMSA 1978, the charter school applicant or charter school may appeal the decision to the secretary as otherwise provided in this section; provided that the secretary shall reverse the decision of the chartering authority only if the secretary determines that the decision was arbitrary, capricious, not supported by substantial evidence or otherwise not in accordance with the law.
F.   A person aggrieved by a final decision of the secretary may appeal the decision to the district court pursuant to the provisions of Section 39-3-1.1

I must defend AP here. They do not spew out press releases. Their Santa Fe guy is the best Capitol reporter we have - [news person 4].  I doubt the accuracy & standards of the "churnalism" review. I think the author is mistaking AP wire stories for press releases or PR handouts. Not the case! [news person 3]

No wonder my complaints about (gov) go unanswered on this [local news site] ... out of 14 original articles only 2 are (gov) ... one of which is titled "2013 legislative session running smoothly." ... (all process, no substance).

diamonds on the tips of the branches


wow ... i am looking at a tree out the south window ... it is bare without leaves ... and there must be ice crystals on the tips of the branches ... because the morning sunrise is shining through them ... making them look like diamonds ... better than strings of clear christmas lights ... but similar ... unbelievable.

chill out and eat crunchies


(mama cat spoiled it) ... a couple days ago i gave her and the kittens a cold hot dog while it was still dark outside ... and then later cooked another one for them while i was preparing my breakfast ... i thought we had a good groove going ... even if i still cannot pet them ...

well, then i got to thinking ... maybe papa cat needs a hot dog too? ... so i chopped one up for him and put it in a bowl outside where i could watch it from the computer ... careful not to let the other cats see or hear me ... i didn't want them to steal his hot dog ... mama cat had previously stolen bacon from him ...

and it was fun watching him ... he came out from under the small house where he stays ... and started sniffing the air ... he could smell something there ... then he took a few steps forward ... still smelling the air ... then, a few more steps ... eventually he found the bowl ... and his first action was to take a big mouthful of diced hot dog and run all the way back to his hiding place under the small house ...

when he returned, he took a different path to the bowl ... and while he ate, he would constantly stop and turn and listen ... as if expecting to be shot at ...

he ate the whole hot dog ... and yes he is getting fat ... must be twice the size he was when i first got here ... but, hey, he is outside, subzero at times ... so i doubt he is complaining ...

so things were good ... he eventually calmed down and enjoyed his hot dog ... and i was grooving inside watching him be "mr. lion" ... sneaking up on the bowl and being careful not to get caught ... and then suddenly from left field mama cat darts out and attacks papa cat ... follows him across the holding pen and kicks the [expletive] out of him ... it was not pretty ... and it completely spoiled the mood ...

so now i have placed everybody on a strict crunchies only diet for a while ... i don't want any hostility at this ranch on account of hot dogs ... so everybody can just chill out and eat crunchies ...

papa cat won't care.

plus one bull calf


just completed the daily critter count ... and there is a brand new bull calf! ... happy birthday buddy ... i even got to pet him.

after two counts, the cow total was still off by one ... so there might be a cow giving birth out in the pasture somewhere, right now, as i write this.

it is too windy to do the count again ... at last check winds were at 36 mph ... making an otherwise alright 29F feel like a cold 13F.

i already gave the cats their hot dog for the evening ... now camo and fur face are in mama cat's condo and everybody else (mama cat, the dark one, and milky) is on the cat couch on the freezer room floor ... (the cat couch is a large couch cushion with a cat bed and blanket on top).

i have just been forced to upgrade my search engine ... which in turn forced me to upgrade my hardware ... and now the search engine is too big for my dial up connection ... and what used to be a slow connection has nearly stopped working all together ...

this is like ... systematic, repetitive, irony ... or murphy's law on steroids ... no, i don't want to guess what could go wrong next ... but i am being very gentle with my car ...

there is no dsl out here ... no cable internet ... just dial up ... satelite ... and phone ... arrrggghhh ... just one provider has coverage.

15 minutes to load one page will drive you insane ... i may have to do a more significant hardware upgrade ... i hope that is where this ends.
