The Food and Drug Administration shut the plant in late September after its products were linked to 41 cases in 20 states.
When the FDA shuttered the plant, it was the first time it used new authority granted under a 2011 food safety law to shut food operations without a court hearing.

FSMA provides for FDA to mandate new produce safety standards and preventive controls for food facilities, among other new measures of authority. Because FSMA covers such wide-ranging areas as prevention, inspection, response, and imports, FDA will implement the new law portions at a time over the next few years.
