pt3 Augustin Plains Ranch (Interstate Stream Commission)

e: ... the proposed Augustin Plains Ranch LLC water project is (almost certainly) intended for "beneficial use" in TEXAS not New Mexico ... with the water pumped directly into the Rio Grande to satisfy the Rio Grande Compact ... and the water buyer being the New Mexico Interstate Stream Commission ... NOT Rio Rancho or the Albuquerque area.

... one possible defense is an interbasin transfers prohibition ... and keep an eye on Rep. Nate Gentry (APR supporter).

The Interstate Stream Commission has broad powers to investigate, protect, conserve, and develop New Mexico’s waters including both interstate and intrastate stream systems. The eight unsalaried members of the Commission are appointed by the Governor. The ninth member is the State Engineer who under state law is the secretary of the Commission. The Interstate Stream Commission Director serves as the deputy state engineer.

The Commission’s authority under state law includes negotiating with other states to settle interstate stream controversies. New Mexico is a party to eight interstate stream basins. To ensure basin compliance, Interstate Stream Commission staff analyze, review, and implement projects in New Mexico and analyze streamflow, reservoir, and other data on the stream systems.

Rio Grande Compact

Signed in 1938, with Colorado, New Mexico, and Texas as parties and approved by Congress in 1939, the Rio Grande Compact apportions the waters of the Rio Grande above Ft. Quitman, Texas, among the three states.

The Rio Grande Compact establishes water delivery obligations and depletion entitlements for Colorado and New Mexico.

"The state engineer denied Augustin Plains Ranch’s application for several reasons, including that the application omitted basic critical details required by law — how, when, where and in what quantities the corporation intended to use water."

"how, when, where and in what quantities the corporation intended to use water" was probably left blank for the Interstate Stream Commission to fill in ... only they could know those answers for delivery downstream to TEXAS ... not APR ... and when the timing is right ... suddenly the Office of State Engineer will approve the application ...

... what a sham.

Supreme Court blocks ruling on water pumping

... part of a broad state drought management strategy, pumping water into the Pecos River to meet the needs of downstream farmers and the state’s legal obligation to deliver water to Texas. 

The pumping is part of a 2003 water deal to address shortfalls on the Pecos. The state agreed to buy up water rights, taking farm land out of production to reduce water consumption in the Pecos Valley. Some of the water rights were to be transferred to the state’s well field so that, in droughts, water could be pumped into the Pecos to meet downstream needs.
